These Terms and Conditions govern your access to and use of Viora Music, a personal audio player and cloud library service provided by Nansha Digital.
By accessing, downloading, subscribing to, purchasing, or using Viora Music, you agree to these Terms. If you do not agree, you must not use Viora Music.
1. Our Service
Viora Music provides personal audio playback, playlist management, library organization, optional cloud backup and sync, offline access to your own imported audio files where available, premium features, and related app services.
Viora Music is designed for private and personal use. Viora Music is not a public music streaming service, music distribution platform, public file-sharing network, or music download service.
Some features may depend on third-party platforms, app stores, payment providers, hosting providers, cloud infrastructure providers, analytics tools, advertising partners, authentication providers, or other external services.
2. Eligibility
By using Viora Music, you confirm that:
- You are legally able to enter into these Terms.
- You are at least the age of majority in your jurisdiction or have permission from a parent or legal guardian.
- Your use of the app complies with applicable laws, platform rules, and third-party service terms.
- Any information you provide is accurate and current.
If you use Viora Music on behalf of a company, organization, or other entity, you confirm that you have authority to bind that entity to these Terms.
3. User Accounts
Some features may require you to create an account, sign in through a third-party provider, or connect a supported app store account.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Ensuring the accuracy of information you provide
- Controlling access to your device and account
- All activity that occurs under your account
- Promptly notifying us of unauthorized access or security issues
We are not responsible for losses caused by unauthorized access resulting from your failure to secure your account, device, email, app store account, or credentials.
If Viora Music allows account creation, you may request or initiate account deletion through the app where available or by contacting us at the email address listed in Section 20.
4. Subscriptions, Purchases, and Billing
Viora Music may offer free features, paid subscriptions, one-time purchases, premium access, cloud storage plans, credits, or other digital products.
By purchasing or subscribing, you agree to pay all applicable fees, charges, taxes, and payment processing costs associated with your purchase.
Payments may be processed by app stores or third-party payment providers. Billing, renewals, cancellation, refunds, and chargebacks may be governed by the rules of the payment provider or app store where you made the purchase.
Unless cancelled before the renewal date, subscriptions may automatically renew according to the plan you select.
Paid cloud storage plans may include storage limits, file limits, usage limits, upload limits, download limits, streaming limits, or other technical limits. These limits may vary depending on your selected plan and may be displayed in the app, on our website, or during the purchase process.
You are responsible for reviewing the plan details before purchasing or subscribing.
5. Cancellation and Refunds
You are responsible for managing your subscription and cancellation through the app store or payment provider where you purchased it.
Cancelling a subscription stops future renewals but does not automatically refund previous payments.
Refund requests may be reviewed by the relevant app store, payment provider, or Nansha Digital where applicable. Digital purchases are generally final once access has been provided, unless otherwise required by law or platform policy.
If your subscription expires, is cancelled, remains unpaid, or is otherwise terminated, access to premium features, cloud backup, cloud sync, cloud streaming, and cloud-stored files may be limited, suspended, or removed.
We may retain cloud-stored files and related library data for a limited grace period after subscription expiry, cancellation, or failed payment. After this grace period, cloud-stored files and related data may be permanently deleted. The specific grace period may be stated in the app, on our website, or in the applicable subscription policy.
Local files stored on your device are controlled by you and are not automatically deleted by cancelling your subscription, unless you delete them yourself or your device settings remove them.
6. Audio, App Materials, and Content Rights
Viora Music allows you to play, organize, import, upload, and manage audio files that you own or have the legal right to use.
Your audio files, cover artwork, metadata, playlist information, and other materials that you upload or import remain your responsibility and may be protected by copyright, trademark, privacy, publicity, or other rights.
The Viora Music app, software, interface designs, branding, logos, documentation, systems, and related materials are owned by or licensed to Nansha Digital.
Access to Viora Music does not transfer ownership of the app, software, branding, or any third-party or user-owned content to you.
You may use Viora Music only for personal, lawful, non-commercial use unless we expressly permit otherwise in writing.
You must not copy, distribute, sell, sublicense, publicly perform, publicly display, scrape, extract, exploit, or misuse any part of Viora Music except as allowed by app features, applicable law, or written permission from the relevant rights holder.
7. User Content
If Viora Music allows you to upload, import, create, save, submit, sync, back up, stream, or share content, you remain responsible for that content.
You confirm that you have the rights and permissions needed to upload, import, save, sync, back up, stream, or share the content through the app.
You grant Nansha Digital a limited, non-exclusive, worldwide right to host, process, transmit, display, store, copy, modify for technical formatting, back up, stream to your account, and otherwise use your content only as necessary to operate, secure, support, maintain, and improve Viora Music.
This permission is limited to providing and improving the service. We do not claim ownership of your uploaded audio files.
Viora Music does not provide public file-sharing features for uploaded audio files in its current version. You must not use Viora Music to distribute audio files to the public, make copyrighted files available to others, or operate a file-sharing service.
We may remove, restrict, disable, or delete user content if we believe it violates these Terms, third-party rights, platform rules, copyright law, or applicable law.
8. Third-Party Services
Viora Music may rely on or link to third-party services, app stores, payment providers, cloud infrastructure providers, analytics tools, advertising partners, authentication providers, external websites, or other service providers.
You understand and agree that:
- Third-party services are operated by independent providers.
- Third-party services may change, limit, suspend, or discontinue their APIs, infrastructure, content, policies, or features at any time.
- We do not control third-party services.
- We are not responsible for downtime, pricing changes, content removals, policy changes, data loss, account restrictions, or service limitations caused by third-party providers.
- Your use of third-party services is governed by their own terms and policies.
Any links to third-party websites or services are provided for convenience only. Unless clearly stated otherwise, we do not endorse, control, or assume responsibility for third-party websites, services, content, or transactions.
9. Acceptable Use
You agree not to use Viora Music to:
- Violate any law, regulation, platform rule, or third-party right
- Upload, import, share, store, sync, back up, stream, or process illegal, infringing, harmful, abusive, defamatory, fraudulent, or unauthorized content
- Infringe copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights
- Upload or store audio files that you do not have the legal right to use
- Distribute, sell, sublicense, publicly share, or make audio files available to others without proper authorization
- Attempt to gain unauthorized access to our systems, third-party services, or other users' accounts
- Interfere with or disrupt the app, servers, networks, APIs, cloud storage, or infrastructure
- Reverse engineer, decompile, copy, resell, sublicense, or exploit the app except as permitted by law
- Abuse free trials, subscriptions, refunds, promotions, rewards, storage limits, file limits, or usage limits
- Circumvent digital rights management, subscription restrictions, access controls, rate limits, quota limits, or security features
- Use automated scraping, bots, scripts, or unauthorized data collection
- Use Viora Music to provide a competing service, public streaming service, public file-sharing service, or unauthorized music distribution service
We may suspend or terminate access if we believe a user has violated these Terms or is using Viora Music in a harmful, abusive, infringing, excessive, or unauthorized manner.
10. Privacy
Our collection and use of personal data is described in our Privacy Policy.
By using Viora Music, you acknowledge that we may process data as described in the Privacy Policy, including data required to operate app features, manage accounts, process payments, monitor usage, provide support, prevent abuse, enforce storage limits, protect rights holders, and improve the service.
11. Software License
Subject to your compliance with these Terms, Nansha Digital grants you a limited, non-exclusive, non-transferable, revocable right to install and use Viora Music for personal, lawful use.
You may not copy, modify, distribute, resell, rent, lease, sublicense, create derivative works from, or exploit the app, software, branding, interface, documentation, or related materials unless we expressly permit it in writing.
This license does not grant you any rights to use the Viora Music name, logo, branding, trademarks, or other proprietary materials except as necessary to use the app as intended.
12. Service Availability and Changes
We aim to provide reliable service, but we do not guarantee uninterrupted, error-free, secure, or always-available operation.
Viora Music may be unavailable due to maintenance, updates, technical issues, internet outages, hosting provider problems, cloud infrastructure problems, payment provider issues, app store issues, third-party service limitations, account issues, storage limitations, legal requests, content removals, or events outside our control.
We may add, modify, suspend, discontinue, or limit any part of Viora Music, including features, plans, pricing, cloud storage limits, file limits, upload limits, download limits, streaming limits, premium features, and usage limits, at any time.
Where required by law or platform policy, we will provide appropriate notice of material changes.
13. Beta or Experimental Features
Some features may be offered as beta, experimental, preview, or early access features.
Such features may be incomplete, unstable, inaccurate, unavailable, or changed without notice. We provide beta features as is and may modify or discontinue them at any time.
You should not rely on beta or experimental features for critical data storage, long-term backup, or permanent access to files.
14. Disclaimer of Warranties
To the maximum extent permitted by law, Viora Music is provided as is and as available without warranties of any kind, whether express, implied, statutory, or otherwise.
We do not warrant that:
- The app will be uninterrupted, secure, or error-free
- The app will meet all of your requirements or expectations
- Cloud storage, sync, backup, streaming, metadata, search results, or personalization will always be accurate, complete, suitable, or available
- User-uploaded files, playlists, metadata, or settings will never be lost, corrupted, delayed, or unavailable
- Third-party integrations, app stores, payment providers, cloud providers, or infrastructure providers will continue to function without changes or interruptions
- Errors or defects will be corrected immediately
You are responsible for maintaining your own backup of important files where appropriate.
15. Limitation of Liability
To the maximum extent permitted by law, Nansha Digital shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of files, loss of content, loss of metadata, loss of playlists, loss of goodwill, service interruption, device issues, system failure, or third-party service failure.
Our total liability for any claim relating to Viora Music shall not exceed the amount you paid to Nansha Digital for Viora Music during the three months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Nansha Digital and its officers, directors, employees, contractors, partners, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from:
- Your use or misuse of Viora Music
- Your violation of these Terms
- Your violation of applicable laws or third-party rights
- Content, files, metadata, artwork, or information you upload, import, submit, save, sync, back up, stream, or share through the app
- Your use of third-party services connected to the app
- Your infringement or alleged infringement of music, audio, artwork, intellectual property, privacy, or publicity rights
- Your attempt to use Viora Music as a public streaming, file-sharing, or unauthorized distribution service
17. Suspension and Termination
We may suspend, restrict, or terminate your access to Viora Music if:
- You violate these Terms
- Payment fails or a subscription expires
- You exceed storage limits, file limits, usage limits, or other plan restrictions
- We detect fraud, abuse, excessive usage, infringement, security risk, or unauthorized activity
- Required by law, court order, app store policy, platform rule, rights holder request, or third-party provider policy
- Continued access may harm our systems, users, partners, rights holders, service providers, or business
Upon termination, your right to use the relevant features will end immediately. We may delete or restrict access to associated data subject to our Privacy Policy, applicable law, and any stated grace period.
If your account is terminated for infringement, abuse, fraud, or serious violation of these Terms, you may lose access to cloud-stored files, premium features, and related account data.
18. Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted on our website. Continued use of Viora Music after changes are published means you accept the updated Terms.
If a change is material, we may notify you through the app, by email, or by other reasonable means where required.
19. Governing Law
These Terms shall be governed by the laws of the Republic of Indonesia, unless otherwise required by applicable consumer protection law.
Any disputes shall first be addressed by contacting us in good faith to seek an informal resolution.
If a dispute cannot be resolved informally, it shall be handled by the competent courts or dispute resolution forum under applicable law, unless another forum is required by mandatory consumer protection law.
